1 Acceptance of Terms
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.
2 Description of Service
The Service provides software that enables users to submit messages to third-party website contact forms. We do not own, operate, or control third-party websites contacted through the Service. All submissions occur solely at the direction of the user.
3 User Responsibility & Compliance
You are solely responsible for submission content, recipient selection, and compliance with all applicable laws. We do not verify consent, permission, or legality on your behalf.
Publicly accessible contact forms are, by their nature, made available for public use by the website owner. Submitting a message through such a form for legitimate business outreach purposes is generally consistent with its intended function. However, you remain solely responsible for ensuring that your use of the Service — including your message content, targeting, and volume — complies with all applicable laws in your jurisdiction, including any anti-spam, data protection, or consumer protection regulations.
You may not use the Service to contact individuals or systems where you have no legitimate basis to do so, or where the website owner has expressly prohibited automated or bulk submissions.
4 Anti-Spam & Regulatory Allocation
You represent that you comply with all applicable anti-spam and data protection laws and have lawful basis for any personal data used. You assume all regulatory risk and liability.
5 Prohibition on Circumvention of Safeguards
You may not use the Service to evade, defeat, interfere with, or undermine technical safeguards, access controls, rate limitations, authentication systems, or security measures of third parties.
6 Acceptable Use
You may not use the Service for unlawful, abusive, fraudulent, deceptive, malicious, or high-volume abusive activities.
7 No Deliverability Guarantee
We do not guarantee submission success, acceptance, response rates, or protection from filtering or blocking.
8 Intellectual Property & Non-Replication
The Service is proprietary. You may not reverse engineer, replicate, copy, decompile, disassemble, or create derivative works. Violations may result in termination, injunctive relief, damages, and legal action.
9 Confidentiality & Trade Secrets
The Service architecture, workflows, systems, and strategies are confidential trade secrets. Obligations survive termination.
10 Logging & Monitoring
We may log IP addresses, submission targets, outreach volume, and usage data for enforcement and compliance purposes.
11 Abuse & Audit Rights
We may suspend or terminate accounts and request documentation demonstrating lawful basis in response to complaints or investigations.
12 Regulatory Cooperation
We may cooperate with regulators or law enforcement and disclose information as legally required.
13 Independent Relationship
No agency, partnership, or employment relationship is created.
14 No Warranty of Legality
We make no representation that use of the Service is lawful in any jurisdiction.
15 Indemnification
You agree to indemnify and hold harmless the Company from claims, fines, penalties, and legal costs arising from your use.
16 Limitation of Liability
The Service is provided "as is." Liability is limited to fees paid in the preceding 30 days. We are not liable for indirect or regulatory damages.
17 Chargeback Abuse
Fraudulent chargebacks constitute material breach and may result in recovery actions.
18 Force Majeure
We are not liable for interruptions beyond our control.
19 Arbitration & Class Action Waiver
Disputes shall be resolved through binding arbitration. You waive class action participation.
20 Survival
Indemnification, liability limitations, confidentiality, arbitration, and intellectual property provisions survive termination.
21 Contact
To submit legal or support inquiries, visit the Contact page on our Website and submit a request through the form provided there.
22 SMS Messages and Communications
A. Consent to Receive Messages
By opting in through our Service, you expressly consent to receive SMS messages and other electronic communications from us at the phone number you have provided. You represent that you own or have authorized use of the phone number provided for this purpose.
B. Opt-Out Instructions
You may opt out of receiving SMS messages at any time by replying STOP to any message you receive. We will honor opt-out requests and remove you from our SMS notification list within a reasonable timeframe.
C. No Guarantee of Message Delivery
We do not guarantee delivery, timeliness, or receipt of SMS messages. Messages may be delayed, not delivered, or subject to carrier filtering. We are not liable for failed, delayed, or undelivered messages.
23 Prohibited Data Sources
You may not use the Service with data that has been obtained in violation of applicable law or third-party rights.
This includes, without limitation:
- personal data obtained through scraping, harvesting, or automated collection in violation of a website's terms;
- contact information collected from sources that prohibit such use;
- purchased or third-party lists obtained or used in violation of applicable law or the provider's terms of service.
You are solely responsible for ensuring that data you use with the Service has been legitimately obtained.
24 No Targeting of Restricted or Protected Systems
You may not use the Service to deliberately attack, compromise, or circumvent security infrastructure. This includes attempting to disable, bypass, or undermine authentication systems, firewalls, or access controls in an unauthorized manner.
Standard form protections such as CAPTCHAs are a normal part of the web — the Service handles common implementations as part of its functionality. This section is not intended to restrict legitimate business outreach through publicly accessible contact forms; it applies to deliberate interference with systems or infrastructure.
25 System Interference Prohibition
You may not use the Service in any manner that interferes with, disrupts, degrades, or places an unreasonable load on any third-party system, network, or infrastructure.
26 Enhanced Indemnification for Communications Activity
Without limiting any other indemnification obligations, you agree to indemnify, defend, and hold harmless the Company from and against any claims, fines, penalties, investigations, or regulatory actions arising out of or related to:
- any messages, submissions, or communications transmitted using the Service;
- allegations of unsolicited communications, spam, or improper outreach;
- alleged violations of data protection, privacy, or consumer protection laws;
- unauthorized interaction with third-party systems.
27 No Control Over User Targeting or Content
The Company does not select, control, review, or approve any recipients, targets, or content transmitted using the Service.
You acknowledge that you are solely responsible for:
- determining who you contact;
- ensuring such contact is lawful;
- ensuring the content of all submissions complies with applicable laws.
28 Right to Restrict High-Risk Usage
The Company reserves the right, in its sole discretion, to restrict, suspend, or terminate use of the Service where it determines that such use:
- presents elevated legal or regulatory risk;
- generates complaints, abuse reports, or legal inquiries;
- targets restricted, sensitive, or protected categories of recipients;
- or otherwise threatens the integrity of the Service or third-party systems.
29 No Representation of Permitted Contact
Nothing in the Service, Website, or any related materials constitutes legal advice or a guarantee that any particular use is lawful in your jurisdiction. You are responsible for independently determining whether your outreach activities comply with applicable law.
For clarity, the existence of a publicly accessible contact form on a website does not by itself prohibit outreach — contact forms are made available by site owners for the purpose of receiving messages. However, it remains your responsibility to ensure your outreach is conducted lawfully, professionally, and in compliance with any applicable regulations.
30 Audit and Verification Rights
The Company reserves the right to request documentation or information to verify compliance with these Terms, including but not limited to:
- the source of contact data;
- the legal basis for communications;
- records of consent or permission.
Failure to provide such information upon request may result in immediate suspension or termination of access to the Service.
31 Enrollment
Participation in the Affiliate Program is subject to approval. We reserve the right to accept or reject any application at our sole discretion for any reason.
32 Affiliate Links & Tracking
Affiliates will be provided with unique tracking links. You are responsible for ensuring links are properly formatted. We are not responsible for tracking failures due to incorrect implementation, browser restrictions, ad blockers, or technical issues beyond our control.
33 Commissions
Commissions are earned only on qualified payments made by referred users. A “qualified payment” is defined as a completed, non-refunded transaction made by an account that is not owned, controlled, operated, or financially connected to the referring affiliate.
Commissions are not earned on:
- Refunded transactions
- Chargebacks or disputed payments
- Fraudulent or self-referred accounts
- Transactions made by accounts owned, controlled, or affiliated with the referring affiliate
We reserve the right to review and reverse commissions in cases of abuse, fraud, or violation of these terms. Commissions found to have been generated through self-referral or affiliated-party referral will be reversed and may result in immediate termination of affiliate participation and recovery of amounts already paid.
34 Payment Terms
Commission payouts are issued on a periodic basis (e.g., monthly), subject to a minimum payout threshold. Payments may be delayed to account for refunds, disputes, or fraud checks. Affiliates are responsible for providing accurate payment details.
35 Prohibited Activities
Affiliates may not:
- Misrepresent our platform or make false claims
- Engage in spam, unsolicited outreach, or illegal marketing practices
- Use trademark bidding (e.g., bidding on our brand name in paid ads) without written permission
- Self-refer, refer affiliated parties, or create or use secondary accounts to generate commissions — including referring accounts you own, control, or have a financial interest in
- Use deceptive redirects, cookie stuffing, or forced clicks
Violation may result in immediate termination and forfeiture of unpaid commissions.
36 Marketing Compliance
Affiliates are solely responsible for ensuring their promotional methods comply with all applicable laws and regulations, including but not limited to:
- Anti-spam laws
- Data protection and privacy laws
- Advertising disclosure requirements (e.g., clearly disclosing affiliate relationships)
37 Intellectual Property (Affiliate)
We grant affiliates a limited, non-exclusive, revocable license to use our brand assets solely for promoting our services. You may not modify brand assets or represent yourself as the company.
38 Termination (Affiliate)
We may suspend or terminate your participation at any time, with or without cause. Upon termination:
- All affiliate links must be removed
- Any unpaid commissions may be forfeited if termination was due to violations
39 Modification (Affiliate)
We reserve the right to modify or discontinue the Affiliate Program at any time. Continued participation constitutes acceptance of any updated terms.
40 Relationship of Parties (Affiliate)
Affiliates are independent contractors. Nothing in this agreement creates any partnership, joint venture, or employment relationship.
